The Supply of Machinery (Safety) Regulations 2008
Amendment
Fom the 20th January 2027, Directive 2006/42/EC on machinery (‘the Machinery Directive’) is being repealed and replaced by Regulation (EU) 2023/1230 on machinery (‘the EU Machinery Regulation’). Due to post-Brexit arrangements with the EU, this change will impact Northern Ireland differently than the rest of the UK. These changes are outlined below for both Northern Ireland and Great Britain.
Northern Ireland
The Supply of Machinery (Safety) Regulations 2008 (these Regulations) will be revoked as they apply to Northern Ireland from the 20th January 2027, and the EU Machinery Regulation will apply directly to Northern Ireland instead. This amendment makes the technical changes required to allow the new regulation to be implemented in Northern Ireland, including:
- confirming that the Health and Safety Executive for Northern Ireland (HSENI) will enforce the requirements for workplace machinery;
- continuing to allow UK conformity assessment bodies to assess machinery for the Northern Ireland market;
- requiring UKNI marking alongside CE marking where a UK conformity assessment body carried out the assessment;
- designating the relevant enforcement bodies as market surveillance authorities; and
- providing for information to be shared with the European Commission and EU Member States.
Great Britain
The Supply of Machinery (Safety) Regulations 2008 (these Regulations) will continue to apply in England, Scotland and Wales after the 20th January 2027. This amendment makes changes to reflect the repeal of the Machinery Directive, so that machinery complying with the EU Machinery Regulation can continue to be placed on the market in Great Britain.
