This Act provides the framework for a number of different areas of environmental regulation including waste management, contaminated land, statutory nuisances and control of litter.

The Environmental Offences (Fixed Penalties) (England) Regulations 2017

These Regulations set out the ranges within which authorities can set penalties for littering, the free distribution of printed matter on designated land, graffiti, fly posting, audible intruder alarms and commercial waste receptacles and noise.

Amendment

Environmental Protection Act 1990 (c. 43)

From 1st September 2026, the upper limit of the amount of a fixed penalty that may be issued for a waste deposit offence is increased from £1,000 to £5,000.

There are no changes to duties for organisations.

The Environmental Offences (Fixed Penalties) (England) Regulations 2017

From 1st September 2026 the upper limit of the amount of a fixed penalty for litter is increased to £750.
