The Digital Waste Tracking (Scotland) Regulations 2026

Summary

From 1st January 2027, operators of waste activities at a permitted facility* must enter specified information into the digital waste tracking system. 

*Operators of waste activities at permitted facilities are those authorised by SEPA through a permit under The Environmental Authorisations (Scotland) Regulations 2018.

The Scottish Ministers are appointed as the ‘designated person’, and must:
  • establish, maintain and operate the digital waste tracking system; and
  • allow SEPA access to the information entered into the digital waste tracking system. 
SEPA is responsible for monitoring compliance with the Regulations and must maintain a list of digitally excluded operators. SEPA can:
  • enter information provided in written format into the digital waste tracking system; 
  • issue compliance notices against the requirements outlined in Regulation 18(2)
  • issue enforcement cost recovery notices to those issued with a compliance notice to cover the costs incurred relating to the compliance notice; and
  • withdraw and amend compliance notices and enforcement cost recovery notices at any point.
