Jurisdiction: England

Commencement: 1st October 2024

Amends: The Building Regulations 2010

Mini Summary

Reasonable standards of health and safety are required to be met for building work. The Building Regulations 2010 replace previous legislation and are supported by the Building (Approved Inspectors etc.) Regulations 2010 in Wales and The Building (Registered Building Control Approvers etc.) (England) Regulations 2024 in England.

Various duties apply and are available to view on The Legislation Update Service.

From 1st October 2024, there is a requirement to have male and female single-sex toilets in buildings other than dwellings. Universal toilets may be provided in addition to single-sex toilets or where space limits single-sex toilets.

Exemptions to this requirement include:

  • en-suite facilities in individual rooms for residential purposes; and
  • residential rooms in care homes, schools and premises used wholly or mainly for early years provision and cellular accommodation in custodial facilities.

Transitional requirements

The requirements do not apply where a building notice, an initial notice, or an application for building control approval with full plans, has been given before 1st October 2024 and the work has either started by that day or is due to start in the 6 months following.
