Under the Town and Country Planning Act 1990 the scope of town and country planning is defined and the legislative framework for structure preparation, local plan, administration and development control is set out. Furthermore, planning permission is required for the development of land or buildings.

 

Duties

 

Planning permission
Planning permission is required for the development of land or buildings. Local Planning Authorities (LPAs) may either :

  • approve an application unconditionally,
  • approve the application subject to conditions, or 
  • refuse the application.

Applications for permission that are not substantially different from existing permission
Applications for planning permission where the applicant considers there to be little substantial difference from an existing planning permission can be conducted under Section 73B. Permission under this new section will only be permitted if the local planning authority deems that the changes will not create a substantially different permission from the existing one. 

Development commencement notices
Before a development can start, the person intending to carry out that development must send a commencement notice to the local planning authority. This notice must include the date on which the development is expected to begin, and any other information required by that local planning authority. 

 

The Secretary of State may require planning permission applications to be referred to them instead of LPAs, for cases in which permission is requested for development in environmentally sensitive areas.

 

Amendment

Changes made by the Levelling-up and Regeneration Act 2023 in relation to Crown developments in England (planning applications for developments on land owned by the Crown) come into effect from 1st May 2025

There are no changes to duties for organisations.
