Mini Summary

The Building Safety Levy (England) Regulations 2025

From 1st October 2026, clients must pay a building safety levy and provide levy information when applying for building control approval of major residential developments providing dwellings or purpose-built student accommodation. Local authorities are responsible for processing levy payments and issuing levy payment certificates.

Amendment

The rules on previously developed sites which will benefit from a discounted building safety levy are updated to exclude:

  • sites where a building was completely underground; and
  • sites where operations have been previously carried out unlawfully.

The definition for building is updated to make it clear that permanent buildings, structures or erections, including areas surfaced with man-made materials and plant and machinery are in scope to be considered as previously developed land.

Technical changes are also made.
