The Ecodesign for Energy-Related Products and Energy Information (Amendment) (EU Exit) Regulations 2020

Amends: Ecodesign for Energy-Related Products and Energy Information (Amendment) (EU Exit) Regulations 2019, under the following pieces:

  • The Ecodesign for Energy-Related Products Regulations 2010 
  • Commission Regulation (EC) No 244/2009 implementing Directive 2005/32/EC with regard to ecodesign requirements for non-directional household lamps 
  • The Energy Information Regulations 2011 
  • Regulation (EU) 2017/1369 setting a framework for energy labelling and repealing Directive 2010/30/EU 
  • Regulation (EU) No 626/2011 supplementing Directive 2010/30/EU with regard to energy labelling of air conditioners 

Amendments

The Ecodesign for Energy-Related Products Regulations 2010 

This amendment came into force immediately before IP completion day (31st December 2020).

Changes are made to a previous amendment, The Ecodesign for Energy-Related Products and Energy Information (Amendment) (EU Exit) Regulations 2019 to take account of changes to European Union (EU) Ecodesign and Energy Labelling legislation since that amendment was made. It also makes changes in light of the Northern Ireland (NI) Protocol, under which it is agreed NI will continue to follow EU rules. Changes include:

  • References to EU terminology are removed or replaced with the relevant United Kingdom (UK) reference.
  • References to ‘exit day’ are replaced with references to ‘IP completion day’.
  • The majority of references to the UK are replaced with reference to Great Britain (GB) (i.e. England, Scotland, Wales).
  • The previous amendment will only apply to GB now. This means the 2010 Regulations will apply in NI without amendment and NI will continue to be subject to EU rules.
  • Changes are made to allow products from GB to go into the NI market. Where products have been certified by a UK body, they must have the UK (NI) mark to be put on the NI market, in addition to a CE mark.
  • The term ‘qualifying Northern Ireland goods’ is introduced. This will allow NI goods to move freely into GB without additional checks or controls above those already in place. This means NI goods that meet the EU Ecodesign and Energy Labelling requirements can circulate on the GB market, even if the requirements differ from GB requirements following EU exit.

The label given in relation to energy labelling of air conditioners in Annex III is changed to only contain text in English and have the UK flag.
