Mini Summary
Directive (EU) 2025/1892 amending Directive 2008/98/EC on waste establishes that EU Member States must take measures to protect human health and the environment by preventing or reducing the generation and negative impacts of waste and by improving resource efficiency.
Requirements for Member States include:
- applying the waste hierarchy in their waste prevention and management legislation and policies;
- establishing rules for when materials are considered by-products and when they achieve end-of-waste status;
- ensuring that permitting is in place for waste treatment, collection and transport;
- implementing record-keeping requirements for those with permits or those producing, collecting or transporting hazardous waste;
- establishing controls for hazardous waste, including packaging and labelling requirements as well as restrictions on mixing;
- establishing waste management plans and waste prevention programmes; and
- establishing and maintaining extended producer responsibility schemes.

For information only. There are no direct compliance duties for organisations under this Directive.
Amendment
EU Member States must introduce legislation by 17th June 2027 to prevent food waste generation and implement an extended producer responsibility scheme for textiles.
The definition for gaseous effluents excluded from Directive 2008/98/EC is also updated, specifying that this relates to gaseous effluents emitted and stored in accordance with Directive 2009/31/EC on the geological storage of carbon dioxide.
There are no duties for organisations under this Directive; duties are held by EU Member States.
