Commencement: 24th October 2023
Amends: Countryside and Rights of Way Act 2000
The Countryside and Rights of Way Act 2000 extends the public’s ability to enjoy the countryside whilst also providing safeguards for landowners and occupiers. It creates a new statutory right of access and modernises the rights of way system as well as giving greater protection to Sites of Special Scientific Interest (SSSIs), providing better management arrangements for Areas of Outstanding Natural Beauty (AONBs) and strengthening wildlife enforcement legislation.
Various duties apply.
The following sections have been brought into force in England.
- Section 53 (extinguishment of unrecorded rights of way).
- Section 54 (excepted highways and rights of way).
- Section 55 (bridleway rights over ways shown as bridleways) and 56 (cut-off date for extinguishment etc.).
These terminate public rights of way over highways.
